‘Tinubu’s Action Unconstitutional,’ Kwankwaso Faults Rivers Emergency Rule

 Former Kano State Governor and leader of the New Nigeria People’s Party (NNPP), Senator Rabiu Musa Kwankwaso, has openly criticized President Bola Tinubu’s recent declaration of a state of emergency in Rivers State. He described the action as unconstitutional and a potential threat to Nigeria’s democratic framework.

In a statement released on his verified social media platforms, Kwankwaso expressed deep concern over President Tinubu’s decision to suspend Governor Siminalayi Fubara, his deputy, and all elected state legislators. He argued that such a unilateral move violates constitutional provisions and undermines the principles of federalism. Kwankwaso emphasized that the political situation in Rivers State did not warrant such an extreme measure, suggesting that existing legal frameworks are sufficient to address any challenges without resorting to emergency declarations. ​

Kwankwaso also criticized the 10th National Assembly for its swift ratification of the President’s proclamation. He accused the legislative body of acting as a “rubber stamp,” failing to exercise its duty to check executive overreach. He expressed disappointment over the use of a voice vote for such a critical decision, arguing that it lacked transparency and due process. ​

The former governor raised alarms about the involvement of military leadership in the enforcement of the emergency rule. He warned that integrating military figures into civilian governance structures could lead to a dangerous erosion of democratic norms and potentially pave the way for authoritarianism. Kwankwaso stressed the importance of maintaining a clear separation between military and civilian roles to preserve democratic integrity. ​

Kwankwaso urged the judiciary to uphold its independence in the face of these developments. He called on judicial authorities to deliver judgments free from external influences, thereby reinforcing the rule of law and preventing the establishment of precedents that could encourage impunity. ​

The declaration of a state of emergency in Rivers State has sparked a nationwide debate about the balance of power between federal and state governments, the role of the military in civilian affairs, and the robustness of Nigeria’s democratic institutions.
