Sean Diddy Combs appeals conviction, citing acquitted conduct in sentencing

Music mogul Sean Combs is set to appear before a U.S. appeals court as his legal team pushes to overturn both his conviction and his prison sentence, arguing that the trial judge improperly relied on evidence linked to charges on which he was acquitted.

Combs is currently serving a 50-month sentence following his conviction on federal prostitution-related charges in New York. He is being held at a federal facility in New Jersey and is expected to remain in custody until 2028 unless his appeal succeeds.

The case stems from a seven-week trial that focused on allegations involving drug-fueled sexual encounters with former girlfriends and paid escorts. While a jury convicted him on transportation-related prostitution counts, he was acquitted of more serious charges, including sex trafficking and racketeering.

Appeal challenges the use of “acquitted conduct” in sentencing

At the centre of the appeal is the argument that the trial judge wrongly considered conduct tied to the acquitted charges when determining Combs’ sentence. His lawyers argue that this amounted to punishing him for offences the jury did not convict him of, which they say violates constitutional protections.

The defence contends that evidence involving alleged threats and coercion, such as claims that Combs threatened to release explicit material or cut off financial support, should not have influenced sentencing for the remaining convictions.

Legal representatives for Combs are asking the U.S. Court of Appeals for the 2nd Circuit to overturn both the conviction and the sentence, arguing that the prosecution’s framing of events unfairly blurred the distinction between consensual conduct and criminal offences.

Prosecutors defend sentencing decision

Prosecutors, however, maintain that the judge was entitled to consider the broader context of Combs’ conduct when imposing the sentence. They argue that even though he was acquitted of sex trafficking and racketeering, related behaviour was still relevant to the prostitution-related convictions.

They further argue that the sentencing reflected the seriousness of the underlying conduct, including alleged abuse and coercion involving former partners identified in court proceedings.

The legal dispute now centres on how far a judge can go in weighing evidence tied to acquitted charges when determining punishment for convictions that remain in place.

A decision from the appeals court is expected to have significant implications for both the music executive’s case and broader federal sentencing practices.
