Impeachment Move: Tension in Rivers as Assembly Serves Governor Fubara Misconduct Notice

The political climate in Rivers State has intensified as the State House of Assembly issued a notice of gross misconduct to Governor Siminalayi Fubara and his deputy, Ngozi Odu, potentially initiating impeachment proceedings. The notice, signed by 26 out of 32 assembly members, alleges several constitutional breaches by the governor and his deputy.

The assembly’s notice outlines specific accusations, including:

  • Unauthorized Appointments: Appointing individuals to government positions without the required screening and confirmation by the assembly.

  • Budgetary Infractions: Failure to present the 2024 Appropriation Bill to the assembly, leading to unauthorized withdrawals from the state’s Consolidated Revenue Fund.

  • Financial Misconduct: Seizure of salaries and allowances meant for the legitimate assembly members, contravening constitutional provisions.

These allegations have been formally communicated to the governor and his deputy, marking a critical juncture in the state’s governance.

The state government, through the Commissioner for Information and Communications, Werisenibo Joseph Johnson, has refuted claims of receiving any official notice. Johnson emphasized that no such document has been delivered to the governor, suggesting potential procedural lapses in the assembly’s actions.

The move by the assembly is perceived by some analysts as part of a broader political struggle within the state. Tensions have escalated following allegations by FCT Minister Nyesom Wike, accusing Secretary to the State Government (SSG), Dr. Tammy Danagogo, of orchestrating the current political unrest. The assembly has petitioned the Economic and Financial Crimes Commission (EFCC) to investigate Danagogo for alleged financial misconduct, further complicating the state’s political landscape.

Legal experts caution that the unfolding events could lead to a constitutional crisis if not managed within the legal framework. Senior Advocate of Nigeria, Abeni Mohammed, highlighted the necessity for strict adherence to constitutional provisions in any impeachment process to maintain the rule of law and prevent potential governance disruptions.
